Brian M. McKell

Brian M. McKell is Of Counsel in the Miami office. His practice focuses on professional liability, general liability, coverage, creditor’s rights, bankruptcy and commercial litigation. Brian has 10 years of experience in the insurance industry, handling professional liability and general liability claims in the capacity as claims and coverage counsel. He also has addressed matters of international business risk insurance in the capacity as underwriting counsel.

Brian has represented non-profit directors and officers, lawyers, real estate professionals, and insurance agents, with professional liability policies, as well as insurers in coverage and bad faith actions for both general liability and professional liability policies. Further, he has been involved with drafting and revising professional liability policy forms. Additionally, Brian has represented partnerships, small businesses, banking institutions and corporations in commercial litigation cases, including prosecution of replevin, as well as collection and foreclosure matters, including post-verdict recovery efforts.

Previously, Brian handled condominium and commercial realty cases, both in litigation of enforcement cases, as well as those in collection and foreclosure. In his current practice, he handles real estate litigation, including title insurance matters.

Brian has represented insurers dealing with application of insurance coverage as an asset of the bankruptcy estate, through successful resolution in bankruptcy court. Through his litigation practice, he has secured favorable motions for summary judgment and successful trial results in both state and federal court.

Brian is fluent in Spanish, including reading and writing.
