Marie Polito Hofsdal

Marie Polito Hofsdal represents banks, lessors and secured creditors in commercial loan workouts, creditors’ rights and bankruptcy matters. Relying on her transactional and litigation skills, Marie utilizes a variety of means to assist lenders in collecting on obligations owed by their borrowers on commercial mortgages, loans, leases, lines of credit, and other secured and unsecured financings.

Whenever possible, Marie works with clients to structure and document modifications or forbearance arrangements that enable debtors to resolve defaulted obligations. In situations that cannot be resolved through the workout process, Marie has prosecuted a variety of enforcement proceedings on behalf of her clients in state and federal courts, including note and guaranty actions, replevin actions, and real estate and personal property foreclosures. She also has extensive experience defending the interests of secured and unsecured creditors in bankruptcy matters, including defending claims objections, prosecuting and defending adversary proceedings, filing relief from stay motions, and negotiating settlements and reaffirmation agreements. In addition, Marie defends clients in actions involving disputes over lien priority and in counterclaims by borrowers for fraud or misrepresentation.

Marie has remained responsive to client needs and has developed innovative strategies in the context of new complexities facing creditors in the current economic and regulatory environment as well as increasingly sophisticated defensive strategies implemented by debtors in litigation. Working within each client’s internal policies and timeline, Marie provides efficient, cost-effective solutions designed to collect the largest possible amount of the obligation owed to the client with the least possible time and cost spent on litigation.
